الملخص

ملخص: أدت أزمة الطاقة ومشاكلها إلى قيام العديد من الدول بالبحث عن مصادر طاقة بديلة أخرى عن تلك المنتجة من الوقود الأحفوري. لذا لجأت إلى الطاقة النووية كمصدر فعال للاستفادة منها في الأغراض السلمية. على الرغم من المزايا العديدة للطاقة النووية، إلا أن استخدامها يبقى محفوفا بالمخاطر التي تنبئ بالدمار البيئي وتهدد سلامة الإنسان في حالة وقوع الحوادث. لذلك أنتج الفكر القانوني نظامًا استثنائيًا يتوافق مع خصوصية الضرر النووي. يتناول موضوع البحث الضرر النووي من حيث مفهومه وفق الاتفاقيات النووية الدولية والتشريعات الوطنية العربية وشروط تحقيقه ليكون قابلاً للتعويض وفق القواعد الاستثنائية. كما يهدف البحث إلى التعويض المستحق من خلال آلية لتعويض المتضررين نتيجة حادث نووي ، وحدود المسؤولية المالية للمشغل، وضمانات الوفاء بالتعويض لصالح المتضررين. يعرض البحث أيضًا الضمان الذي يوفره التأمين النووي. وتدخل الدولة لضمان التعويض في حال عدم كفاية التغطية التأمينية . Abstract: The energy crisis and its problems led many countries to search for alternative energy sources other than those produced from fossil fuels. Therefore, it resorted to nuclear energy as an effective source to benefit from it for peaceful purposes. Despite the many advantages of nuclear energy, its use remains fraught with risks that predict environmental destruction and threaten human safety in the event of accidents. Therefore, legal thought produced an exceptional system that corresponds to the specificity of nuclear damage. The topic of research deals with nuclear damage in terms of its concept according to international nuclear agreements and Arab national legislation and the conditions for achieving it to be compensable according to the exceptional rules. The research also aims at the compensation due through a mechanism to compensate those affected as a result of a nuclear accident, the limits of the operator's financial liability, and guarantees for the fulfillment of compensation for the benefit of those affected. The .research also presents the guarantee provided by nuclear insurance. The state intervenes to ensure compensation in the event of insufficient insurance coverage
