حق المريض في الرّضا أثناء ممارسة الأعمال الطّبية The Patient's Right To Give Consent Prior To Medical Work

الملخص
تهدف هذه الدّراسة إلى بيان رضا المريض الذي يعتبر من أهم الالتزامات الملقاة على عاتق الطّبيب، إذ من واجبه الحصول على رضا المريض قبل أي تدخل طبي، وهذا احتراما لمبدأ إرادة المريض بحيث يتجسد هذا المبدأ من خلال الحصول على الرّضا الحر والمستنير للمريض، وتخلف هذا الرّضا يجعل الطّبيب مسؤول عن المخاطر التي ترتبت عن ممارسته المهنية الطّبية ولو لم يرتكب أي خطأ. واستثناءًا يمكن للطّبيب أن يتجاوز رضا المريض في حالة الضّرورة والاستعجال إذا كان فاقدا لوعيه ويحتاج لتدخل طبي سريع بغية إنقاذ حياته. كما توصلنا من خلال هذه الدراسة إلى نتائج مهمة تتمثل في أهمية عنصر الرضا بالنّسبة إلى المريض باعتباره الطرف الضعيف في العلاقة الرابطة بينه وبين الطبيب. This study aims to highlight the importance of the patient's consent as one of the important binding authorizations that the physician must seek before any medical intervention, in accordance with the principle of the patient's will which is translated by the obligation to obtain the free and informed consent of the latter, to be immune from any liability related to the risks attached to the medical act practiced in the framework of the exercise of this profession; even if no fault is found against him. Exceptionally, the physician may override the obligation to obtain the patient's consent in cases of extreme urgency requiring rapid medical intervention to save the life of a patient who is unconscious and in danger of death.
