تقييد حرية المبادلات التجارية الإلكترونية في تحقيق الأمن المعلوماتي

الملخص
اهتم المشرع الجزائري بمسألة الأمن المعلوماتي عند إبرام العقود التجارية الالكترونية في البيئة الرقمية، حيث دأب إلى تقييد الحرية التعاقدية للمورد الالكتروني في قانون التجارة الالكترونية رقم 18/05، فيما يتعلق بكيفية التعامل مع الخصوصية المعلوماتية للحياة الخاصة للزبون وضرورة احترامها، من خلال إلزامه عند جمعه للمعلومات الشخصية المتعلقة بالمستهلك الالكتروني، ألا يجمع إلا المعطيات الضرورية لإبرام المعاملات التجارية الالكترونية، وضمانه لأمن نظم المعلومات وسرية البيانات، تفاديا لانتهاكها واستغلالها، كما يلتزم المورد الالكتروني بعدم الاطلاع على البيانات الشخصية إلا بعد حصوله على الموافقة المسبقة من طرف المستهلك الالكتروني بغية تشكيل ملفات الزبائن الخاصة بالمعاملة الالكترونية، فهذا التقييد يجعل المورد الالكتروني حريصا أكثر على المحافظة على خصوصية المعلومات، مما يسفر على تحقيق الأمن المعلوماتي الذي ينعكس إيجابيا على تفعيل التجارة الالكترونية وتشجيعها. The Algerian legislator has been concerned with the issue of information security when concluding electronic commercial contracts in the digital environment, as it has tended to restrict the contractual freedom of the electronic resource in the Electronic Commerce Law No. 05/18, regarding how to deal with the information privacy of the customer's private life and the need to respect it, by obliging him when collecting it For the personal information related to the electronic consumer, to collect only the data necessary for the conclusion of electronic commercial transactions, and his guarantee of the security of information systems and the confidentiality of data, in order to avoid their violation and exploitation, and the electronic supplier is obligated not to access the personal data except after obtaining the prior consent of the electronic consumer in order to form customer files Related to the electronic transaction, This restriction makes the electronic supplier more keen on preserving the privacy of the information, which leads to achieving information security that is positively reflected on Activating and encouraging electronic commerce
