دور القاضي المقرر في توجيه إجراءات سير الخصومة الإدارية وفق قانون الإجراءات المدنية والإدارية الجزائري

الملخص
يعتبر القاضي المقرر الجهة التي تدير الدعوى الإدارية، حيث يؤدي دورا ايجابيا يشبه دور قاضي التحقيق، أين يهدف لتحقيق التوزان بين المتقاضي والإدارة، فلا يمكنه الاكتفاء بما يقدمه الأطراف المتنازعة بل عليه أن يوجه الأطراف وأن يأمر بأي إجراء يراه ضروريا بصفة تلقائية، لأنه يتحكم في إدارة الخصومة فيلزم الأطراف المتنازعة بتسليم المذكرات الجوابية بإيداع المستندات، ويأمر بإجراء التحقيق الذي يراه مناسبا للفصل في النزاع. The reporting Judge is the body that manages the administrative case, as he plays a positive role similar to that of the investigating judge. Where it aims to achieve a balance between the litigant and the administration, he cannot be satisfied with what the conflicting parties provide, but rather he must direct the parties and order any action he deems necessary automatically. Because it controls the management of the litigation, it obliges the disputing parties to deliver the response notes by depositing the documents, and orders an investigation that it deems appropriate to settle the dispute.
