القواعد العامة للجرائم الاقتصادية في التشريع الجزائري General Rules For Economic Crimes In Algerian Legislation

الملخص
يختلف مفهوم الجريمة الاقتصادية من بلد إلى آخر حسب نظامها السياسي، وما إذا كان ذلك النظام رأسمالي أو اشتراكي، حيث ما يعد جريمة اقتصادية في بلد يعد عملاً مشروعاً في بلد آخر، فالجرائم الاقتصادية يتسع نطاقها في الدول الاشتراكية والدول النامية عنها في الدول المتقدمة والرأسمالية، إذ أن الدول الاشتراكية والدول النامية تعتمد في خطط التنمية على سياسة توجيه الاقتصاد وتركيزه، بحيث تحتاج إلى سياج قانوني يحميها من الجريمة الاقتصادية، وهذا السياج توفره لها التشريعات الاقتصادية العقابية. وفى ظل المتغيرات المستجدة في العصر الحديث، وبروز أنماط من السلوك تمثل خروجاً على القاموس الطبيعي للحياة، دفعت المجتمعات إلى اللجوء تجريم هذه الأنماط وفرض العقوبات عليها، وقد تجلى هذا أكثر في المجال الاقتصادي فظهرت الجرائم الاقتصادية. إنه من الصعوبة وضع مفهوم محدد للجريمة الاقتصادية حتى بالنسبة للدول التي سنت تشريعات مستقلة للجريمة الاقتصادية، وذلك لأن اهتمام التشريعات لا يكون منصبا على وضع تعريف للجريمة الاقتصادية، بقدر ما يكون اهتمامها منصبا على تحديد الجرائم التي تدخل في نطاق الجرائم الاقتصادية وطرق مكافحتها، حيث حددت لها عقوبات مختلفة قد تكون جزائية أو غير جزائية، وذلك حسبما حددها المشرع الجزائري. The concept of economic crime differs from one country to another according to its political system, and whether that system is capitalist or socialist, as what is considered an economic crime in one country is a legitimate act in another country, so economic crimes are more widespread in socialist countries and developing countries than in developed and capitalist countries, As socialist countries and developing countries depend in their development plans on a policy of directing and focusing the economy, so they need a legal fence that protects them from economic crime, and this fence is provided by punitive economic legislation. In light of the new changes in the modern era, and the emergence of patterns of behavior that represent a departure from the natural dictionary of life, societies have pushed to resort to criminalizing these patterns and imposing penalties on them, and this was more evident in the economic field, and economic crimes appeared. It is difficult to develop a specific concept of economic crime even for countries that have enacted independent legislation on economic crime, because the attention of legislation is not focused on setting the definition of economic crime, as much as its interest is focused on identifying crimes that fall within the scope of economic crimes and methods of combating them. It has various penalties that may be penal or non-penal, as defined by the Algerian legislator.
