الملخص
انطلاقا من إحدى أهم الضمانات التي كفلها القانون لحماية حقوق الأفراد في المجتمع، وحفاظا علي عنصري الثقة والائتمان في المعلومات من جهة وخلق أداة فعالة في يد السلطة لمراقبتها من جهة أخرى ، ومع توجه الجزائر من نظام الاقتصاد الموجه إلي نظام الاقتصاد الحر وما شهدته من انعكاسات ، فقد برز دور الموثق بشكل كبير في الآونة الأخيرة، فقد خصه المشرع الجزائري بمكانة مميزة من خلال سنه لقانون ينظم هذه المهنة وفي نفس الوقت ترتيب جزاء في حالة الإخلال بأحكامه أو المساس بمبادئه، مما يجعل فكرة مسؤولية الموثق قائمة حتى لا تهدر حقوق المتعاملين في حالة الأخطاء الناجمة عن ذلك؛ لاسيما الأخطاء غير العمدية. لقد ظهر التوثيق بظهور المجتمعات وعلى مر التاريخ والحضارات، ويعتبر التوثيق العمود الفقري من الناحية القانونية لكل نظام اقتصادي والضامن الأساسي للمتعاملين، لذا يتمتع هذا الأخير في المجتمعات الحديثة بأهمية بالغة ومكانة هامة، حيث منحت لأعمال الموثق الثقة والمصداقية وللمحررات التي حررها القوة التنفيذية الرسمية، فهي واحة التنفيذ بذاتها بغير حاجة إلى رفع دعوى واستصدار حكم بالحق الثابت فيها. Proceeding from one of the most important guarantees guaranteed by the law to protect the rights of individuals in society, and to preserve the elements of trust and trust in information on the one hand, and to create an effective tool in the hands of the authority to monitor it on the other hand, and with Algeria moving from the directed economy system to the free economy system and the repercussions it witnessed, The role of the notary has emerged greatly in recent times, as the Algerian legislator singled him out with a distinguished position by enacting a law regulating this profession and at the same time arranging a penalty in case of breaching its provisions or compromising its principles, which makes the idea of the responsibility of the notary existing so as not to waste the rights of dealers in the event of errors. resulting from it; Especially unintentional errors. Documentation has appeared with the emergence of societies and throughout history and civilizations. Documentation is considered the legal backbone of every economic system and the basic guarantor for dealers. Therefore, the latter in modern societies enjoys great importance and an important position, as trust and credibility were granted to the work of the notary and to the papers edited by the official executive force. Oasis implementation itself without the need to file a lawsuit and obtain a ruling on the right established therein.
