الملخص
ملخص: تعالج هذه الورقة البحثية الإطار المفاهيمي والقانوني للرقابة اللاحقة (البعدية) على أموال الجماعات المحلية، من خلال تسليط الضوء على دور مجلس المحاسبة كآلية دستورية وأعلى هيئة مستقلة أوكلت لها هذا النوع من الرقابة، مع التركيز على تقييم دوره في حماية المال العام من خلال ممارسته لصلاحياته الإدارية، والقضائية، والاستشارية، ومقاربة مختلف نقاط الضعف وأوجه القصور التي قد تحول دون نجاح وفاعلية رقابته ومنه الوقوف على سبل تفعيل دوره وفق دستور 2020. خلصت الدراسة إلى تقديم جملة من التوصيات والاقتراحات كحتمية تعزيز استقلالية المجلس وتدعيمه بالضمانات والوسائل الكافية والأخذ بتوصياته واقتراحاته، وتنسيق العمل بينه وبين باقي أجهزة الرقابة المالیة الأخرى في الدولة. Abstract: This research paper deals with the conceptual and legal framework of the subsequent (post) control over the funds of territorial authorities, by highlighting the role of the Court of Auditors as a constitutional mechanism and the highest independent body entrusted with this type of oversight, with a focus on evaluating its role in protecting public money through the exercise of its administrative, jurisdictional and consultative powers, and approaching various weaknesses that may prevent the success and effectiveness of its oversight, including finding ways to activate its role in accordance with the 2020 constitution. The study concluded by presenting a number of recommendations and suggestions, including the imperative to strengthen the independence of the Court and support it with adequate guarantees and means, take its recommendations and suggestions, and coordinate work between it and the rest of the other financial control bodies in the state.
