قراءة قانونية في علاقات الدولة بالجماعات المحلية على ضوء المادة 18 من دستور 2020

الملخص
ملخص: تهدف هذه القراءة القانونية إلى إبراز العلاقات بين الدولة والجماعات المحلية القائمة على مبادئ اللامركزية الإدارية وعدم التركيز الإداري انطلاقا من المادة 18 المستحدثة في دستور2020، وذلك باستقرائنا للدساتير السابقة ولأهم النصوص القانونية الأخرى ذات الصلة بالجماعات المحلية. ومن خلال هذه القراءة توصلنا إلى أن علاقة الاستقلالية لهذه الجماعات عن الدولة والتي تُعد غاية التنظيم الإداري اللامركزي تم النص على أهم عناصرها، من إقرار قانوني بوجود هذه الجماعات و انتخاب واختصاصات محلية. كما أسست هذه النصوص كذلك لعلاقة تبعية من خلال مبادئ عدم التركيز الإداري ممثلة في الوجود المكثف لأجهزة معينة على المستوى المحلي وخضوع الجماعات المحلية لرقابة مشددة، مما يجعل من المادة18 السابقة مجرد نص كاشف لعلاقات موجودة ومكرّسة. Abstract: principles this reading aims to highlight the relations between State and local authorities based on the of administrative decentralization and deconcentration, based on the newly created Article 18 in the 2020 Constitution, by extrapolating from previous constitutions and the most important legal texts related to local authorities. We concluded that the relationship of these groups' independence from the State, which is the goal of decentralized administrative organization, the most important elements of it were stipulated, such as legal recognition of the existence of these authorities, election and local competences. These texts also established a relationship of dependency through the principles of administrative deconcentration represented by the intense presence of certain agencies at the local level and the subordination of local authorities to tight control, this makes the aforementioned Article 18 just a text that reveals an existing and dedicated relationship.
