دور الوسائل القانونية في تكريس مبدأ استقلالية سلطات الضبط الاقتصادي في شقها الوظيفي

الملخص
بغية قيام سلطات الضبط الاقتصادي بوظيفة ضبط المجال الاقتصادي والمالي والإشراف عليه بما يتماشى ومقتضيات التوجه الجديد القائم على سياسية اقتصاد السوق، قام المشرع بتجهيزها بنظام قانوني تحكمه ميزة الاستقلالية التي تجعلها تمارس مهامها ووظائفها بكل حياد وموضوعية، بما تراه ملائما لوظيفتها الضبطية وغير مهتمة بالتوجيهات والضغوطات التي تفرضها عليها بعض الأجهزة السياسية والحكومية. ومن بين الأدوات التي اعتمد عليها المشرع في إطار سعيه إلي استكمال استقلالية هذه السلطات في جانبها الوظيفي، هي الوسائل القانونية المجسدة في قدرة إعداد نظامها الداخلي الذي ينظمها ويسيرها وامتلاكها لشخصية معنوية تسمح لها بإبرام عقود واتفاقيات باسمها ولحسابها وتمثيل نفسها أمام القضاء، فضلا عن تحملها مسؤولية النتائج المترتبة عن أعمالها وتصرفاتها . Abstract: In order for the economic regulatory authorities to be able to control and master the economic and financial fields, in accordance to the new orientation requirements based on the market economy policy, the legislator established a particular legal system for them. It is characterized by independence. This allows them to impartially and objectively exercise their functions and missions, according to what seems suitable for their regulatory function, without taking care about the directives and pressures from certain political and governmental bodies. Some of the tools adopted by the legislator to confirm and enforce the independence of these authorities in their functional aspect, are the legal means enshrined in the possibility of organizing their internal system that regulate them, and benefit from a legal personality It also allows them to conclude contracts, agreements, represent themselves, and take responsibilities for their actions.
