الملخص
ملخص: نتناول في هذه الورقة العلمية أسس العدل والقضاء عند الأمير عبد القادر الذي يعتبر صاحب أول مشروع لإقامة دولة وطنية في الجزائر؛ جمعت في طياتها مختلف التنظيمات والمشاريع الحضارية فلم يفرق بين الدين والسياسة بل جعل من الإسلام ومبادئه السمحة مشروعا لدولته في إطارها الداخلي ومبدأ في معاملاته الخارجية، مدفوعا في ذلك بمآثر السلف الصالح منهم الخليفة "عمر بن الخطاب"،ومن ثمرات ذلك قضائه على الرشوة في المعاملات والاستبداد في التعامل، واعتمد في إصدار أحكامه القضائية على مذهب الفقه المالكي واستشاراته للعلماء ورؤساء القبائل وبأخذ فتاوي رجال الدين في مواقفه وقراراته المصيرية.
