الملخص
نبحث من خلال هذا المقال كل معيقات الإنجاب عند الزوج بغض النظر عن قدرته على الاستمتاع، ثم نتبين انعكاساتها على استقرار الرابطة الزوجية من خلال استحضار الأحكام الشرعية والقانونية، مع استكشاف إمكانيات العلاج الطبية المستحدثة و مقابلتها بالآراء الفقهية المختلفة بهذا الشأن و مدى ملائمتها و استيعابها لكل الحالات، كما نبحث مدى حق الزوجة في المطالبة بفك الرابطة الزوجية والتعويض لعدم الإنجاب. توصلنا من خلال البحث إلى وجود عوائق تمنع الإنجاب وأخرى تؤخره إلى آجال غير مضبوطة رغم أن الأطباء والفقهاء يضربون أجل السنة لترتيب الآثار الشرعية و القانونية، كما وجدنا أن التطور الطبي ساهم بقدر كبير في علاج كثير الأزواج الذين تأخر الإنجاب منهم، ذلك ما يستدعي مراجعة الأحكام الفقهية و النصوص القانونية لتواكب التطور الطبي المتسارع في هذا المجال، و كم نحن بحاجة إلى تحديد الوسائل الشرعية للمساعدة على الإنجاب بعثا للأمل ومساهمة في استقرار عديد الأسر من جهة، و منع الفساد في هذه العملية والوقوع في المحظور من جهة أخرى، مع إجازة الزوجة في طلب التطليق، ثم لمسنا ضرورة التفصيل أكثر في مسائل الفرقة لتلك الأسباب وأحكام تعويض ضرر الزوجة توحيدا للعمل القضائي. Abstract: Through this article, we examine all the obstacles of reproduction of the husband regardless of his ability to enjoy, and then we see its implications for the stability of the marital bond through the invoking of legal and legal provisions, while exploring the possibilities of medical treatment created and meeting with the different jurisprudential opinions in this regard and the extent of its suitability and absorption of all cases, as well as the extent of the right of the wife to demand the dismantling of the marital bond and compensation for non-reproduction. We have found through research the existence of barriers preventing reproduction and others delay it to uncontrolled deadlines even though doctors and jurists strike the year to arrange the legal and legal effects, as we found that medical development contributed a great deal to the treatment of many couples whose children are late, this calls for a review of jurisprudential provisions and legal texts to keep pace with the rapid medical development In this area, and how much we need to identify the legitimate means of assisting reproduction to give hope and contribute to the stability of many families on the one hand, and to prevent corruption in this process and to fall into the taboo on the other hand, with the wife's leave to request a divorce, then we have seen the need to elaborate more on the issues of the division for those reasons and provisions.
