الملخص
الدراسة محل البحث هي صيغة وقفية غير تقليدية، يمكن لها أن تمد عملية الوقف بالمزيد من القوة والفعالية، ولأن الوقف أحكامه اجتهادية فقد اعتبره العلماء المحدثين من أكثر أبواب الفقه الإسلامي عرضة للتجدد والتنوع كونه ذو علاقة وطيدة بالمال، والمال أشكاله متعددة ومتنوعة بحسب ما تعارف عليه الناس في مختلف معاملاتهم، ومن أشكال المال المعاصرة لفئة معينة من الناس ما يسمى "الحقوق المعنوية والمنافع" والتي تعتبر أموالا غير مادية يمكن الاستفادة منها في النشاط الوقفي لما تشكله من مجال خصب لاستثمار الأوقاف في الوقت المعاصر المتزامن مع عصر التكنولوجيا والثورة الرقمية، ويهدف البحث إلى تحديد مفهوم وقف المنافع والحقوق المعنوية مع بيان مشروعيتها وتطبيقاتها المعاصرة. Abstract : The study in research is an unconventional endowment formula that can give the waqf process more power and effectiveness, and because the endowment has judgments in its jurisprudence, contemporary scholars considered it one of the chapters of Islamic jurisprudence most subject to renewal and diversity due to its close relationship with money, and money has many and varied forms according to people’s dealings, among the contemporary forms of money are the, so-called moral rights and benefits, which are considered intangible money that can be used in endowment activity because it is a fertile field for investing endowments in line the technology and the digital revolution, therefore, the research aims to define its concept of endowment benefits and moral rights, with a statement of its legitimacy and contemporary applications.
