" القوة القانونية للرقابة القضائية على قرار تسريح الموظف"

الملخص
تقف رقابة القاضي الإداري على قرار التسريح في مجال الوظيفة العمومية، على معالم تشكل ضمانة حقيقية لحماية الموظف الخاضع للتأديب، حيث لا تقتصر هذه الرقابة على مدى فحص أركان قرار التسريح للكشف عن مدى مشروعيته و إنما تتعدى ذلك لتشمل مدى ملائمته. غير أن حجر الزاوية في هذا الموضوع، هو إبراز القوة القانونية للرقابة القضائية على قرار تسريح الموظف، فهل تمتد إلى حد فرض تنفيذ قراراتها على الإدارة و الزامها بإرجاع الموظف إلى وظيفته؟ إن الإجابة على هذه الأسئلة تقتضي إبراز نوعية الرقابة القضائية على قرار تسريح الموظف و قواعدها(المبحث الأول)، و توضيح الآثار القانونية المترتبة عنها و مدى فعاليتها أمام الحالات الحرجة(المبحث الثاني).
