نظام الشهر العقاري في الجزائر – تجربة جزائرية أم تيهان تشريعي- The Real Estate Registration System In Algeria - Algerian Experience Or Legislative Ambiguity-

الملخص

يعد نظام الشهر العقاري إحدى أهم دعائم الضبط العقاري، فشهر التصرفات العقارية وإعلانها للكافة هو أحسن ضمان لتدعيم استقرار الملكية العقارية، وفي هذا الإطار يسود نظامان للشهر العقاري، نظام الشهر الشخصي ونظام الشهر العيني. وفي الجزائر وإبان الفترة الاستعمارية وحتى لسنوات طويلة بعد الاستقلال تم تطبيق نظام الشهر القائم في فرنسا آن ذاك . غير أن الجزائر غيرت معتقدها وأسست لنظام الشهر العيني. والثابت أن تبني نظام الشهر العيني يقتضي استكمال إجراءات المسح التي لم تكتمل بعد الأمر الذي استدعى من المشرع أن يتدخل لفرض حلول آنية ظرفية أدت إلى الابتعاد عن الثابت والمتعارف عليه في نظام الشهر العيني ، بل وأن نظام الشهر العقاري في الجزائر به بعض الابتعاد عن تلك الثوابت . The real estate registration system is one of the most important pillars of real estate control, the real estate behaviors and its declaration to all is the best guarantee to strengthen its ownership stability, and in this context prevails two systems of real estate, personal and in-kind. In Algeria, during the colonial period and even many years after independence, the French regime was implemented at that time. However, Algeria had changed its thought through establishing the in-kind system. It is well established that the adoption of the in-kind system requires the completion of the survey procedures, which have not yet been completed, although it required the legislator to intervene in order to impose real-time solutions that led to move away from the fixed and accepted in the system of the in-kind, and even that, the system of the real estate is somewhat removed from these constants in Algeria.
