دور نظام الشهر العيني في حماية الملكية العقارية الخاصة The Role Of The Real Estate Publicity System In Protecting Private Estate Properties

الملخص
ملخص يعد الشهر العقاري من الإجراءات الإجبارية لتحقيق الأمن و الاستقرار في التعامل العقاري بحيث يهدف هذا الإجراء إلى تسجيل مختلف التصرفات الواردة على هذا العقار لدى إدارة الشهر العقاري لإعلام الكافة بها، و ذلك من أجل تنظيم الملكية العقارية و تأمين استقرار المعاملات العقارية و منع المضاربة تحقيقا للثقة الطمأنينة لدى المتعاملين في العقار، مما يستلزم عند الإقدام على أية معاملة عقارية الاطلاع فورا على الوضعية الحقيقة للعقار و لا يتم ذلك إلا بالاتصال بمصالح مسح الأراضي والحفظ العقاري، لذلك كان لنظام الشهر العيني دورا محوريا في عملية الإفصاح على الوضعية الحقيقية و القانونية للعقار بواسطة الدفتر العقاري الذي يتميز بحجية قانونية تكاد تكون مطلقة في محتواه، فكان لزاما علينا كمتخصصين عمليا تفضيل هذا النظام عن نظام الشهر الشخصي المحفوف بالمخاطر والذي غالبا ما اكتنفه الغموض وبالتالي العيوب . علما ان لمسح الأراضي دور هام في عملية التطهير العقاري، الذي يعتبر الأداة الفعالة في انجاز كل العمليات المسحية والتي على أساسها يتم التأسيس العقاري وبالتالي استخراج الدفاتر العقارية. Abstract: The Real estate register is contained as mandatory procedures to ensure secure and stable land transactions. This procedure aims at recording all actions related to property at the real- estate department so as to inform all- thus, it would be easier to organize property ownership, to ensure property transaction stability , and to prevent any kind of speculation in order to consolidate the confidence and quietness of real - estate traders- this will imperatively lead to an immediate access to the real satiation of property at any real estate transactions according to the land surveying services and land registration. Ocular real estate registering system has got a key role in claiming the real and legal situation of property through the real estate book which is fitted with au almost absolute legal force in its content- As specialists, we are obliged to foster this system in prochoice, of the individual registering system which is exposed to all kinds of risks and uncertainty and thus to lots of deficiencies. Cadastral work has an important role in the Real estate clearance process. It's the most efficient instrument in surveying land which is the basis on which all property is established and a real estate mark is delivered.
