الملخص
الزواج العرفي ظاهرة اجتماعية عرف تزايد ملحوظ في الجزائر و الدول العربية رغم صراحة النصوص القانونية بضرورة توثيق عقود الزواج، ما جعل المشرعين سواء في الجزائر او الدول العربية يبحثون عن حلول قانونية لتوثيقه و معهم القضاء الذي يجد نفسه امام واقع يفرضه علية الاعتراف بالزواج العرفي لاسيما اذا ترتب عنه أطفال فصونا للنسب لابد من تثبيت الزواج العرفي امام القضاء. فماهي إجراءات إثبات الزواج العرفي أمام القضاء و ما هي إشكالات المطروحة عمليا؟ الكلمات المفتاحية: زواج عرف قضاء اثبات. Abstract Customary marriage is a social phenomenon that has become increasingly apparent in Algeria and the Arab countries, despite the explicit legal provisions that marriage contracts should be documented, making lawmakers in Algeria or Arab countries looking for legal solutions to document them and with them the judiciary which finds itself faced with a reality imposed by customary marriage recognition, As a result of the separation of classes, the customary marriage must be established before the courts.
