الملخص: لا يمكن لأي عقد أن يبرم دون احترام شكل خاص، أقره الفقه له وألزمته النصوص به؛ والتبرعات العقارية من جملة العقود التي تخضع لهذا المبدأ العام، ولكنها تختص مع ذلك وفي بعض الأحيان بأشكال خاصة، كإسقاط الرسمية عنها، أو الاعتماد على أشكال مميزة كـالقبض أو الحيازة؛ ولذلك، يكون الغرض من التعرض لهذا الموضوع كشف هذه الاستثناءات والميزات التي تتأثر بالطبيعة الخاصة للتبرعات. Abstract: No contract can be concluded without respect for a particular form, approved by the jurisprudence and the provisions of the texts, and the real estate donations from the contracts subject to this general principle, but in many cases it is specialized in special forms, as a projection the authentication or rely on a special form Such as possession , therefore the purpose of the exhibition on this subject is to disclose those exceptions and characteristics affected by the particular nature of the donations.
