حقوقُ الملكيةِ الفكريةِ للعباراتِ الهزليةِ ( النكاتُ ) في مجالِ الكوميديا الارتجاليةِ

الملخص
تهدفَ الدراسةُ إلى فهمِ الأنواعِ المختلفةِ منْ النكاتِ لغرضِ تقديرِ النطاقِ المتنوعِ للفكاهةِ والاستمتاعِ بالإبداعِ الكوميديِ الموجودِ في تجربتنا الإنسانيةِ المشتركةِ . لذا تعدْ حمايةُ حقوقِ الملكيةِ الفكريةِ للعباراتِ الهزليةِ مجالاً متطورا يهدفُ إلى الاعترافِ بالجهودِ الإبداعيةِ للممثلينَ الهزليينَ وتزودهمْ بالأدواتِ القانونيةِ لحمايةِ نكاتهمْ . كما تهدفُ إلى البحثِ في القضيةِ المعقدةِ لحقوقِ الملكيةِ الفكريةِ للعباراتِ الهزليةِ في مجالِ كوميديا الارتجالِ وتستكشفُ التحدياتُ التي يواجهها الممثلونَ الكوميديونَ في حمايةِ نكاتهمْ والنزاعاتُ المحتملةُ التي قدْ تنشأُ فيما يتعلقُ بالملكيةِ الفكريةِ . واستكشفتْ الدراسة أسبابَ عدمِ وجودِ نزاعاتٍ كبيرةٍ بينَ الكوميديينَ فيما يتعلقُ بملكيةِ النكاتِ ، وكيفَ تمَ التعاملُ معَ بعضِ الحالاتِ التي وصفتْ بأنها انتهاكاتٌ لحقوقِ الملكيةِ الفكريةِ. ولقدْ توصلتْ الدراسةُ إلى أنَ قوانينَ الملكيةِ الفكريةِ الحاليةِ تحمي في المقامِ الأولِ التعبيرَ عنْ الأفكارِ وليسَ الأفكارَ نفسها . الأمرُ الذي قادنا إلى التعمقْ في دراسةٍ عالمِ الكوميديا الارتجاليةِ ، لأهميتها كمصدرٍ غنيٍ للنكاتِ الأصليةِ والمتنوعةِ ، فضلاً عنْ تعرضها لحالاتِ الانتحالِ أكثرَ منْ غيرها . نستكشفُ أيضا تعقيداتِ حمايةَ حقِ المؤلفِ في النزاعاتِ المتعلقةِ بالنكاتِ ، ولضمانَ تطبيقٍ عادلٍ لحقوقِ الملكيةِ الفكريةِ في هذا المجالِ تقدمَ الدراسةِ عدةَ توصياتٍ لمواجهةِ هذهِ التحدياتِ منْ ضمنها ضرورةُ تطويرِ إرشاداتِ ومعاييرَ أوضحَ داخلَ صناعةِ الكوميديا الارتجاليةِ ، وتثقيفَ الكوميديينَ حولَ قوانينِ الملكيةِ الفكريةِ ، وتشجيعَ الحوارِ المفتوحِ ، والدعوةُ إلى حمايةٍ قانونيةٍ أقوى. The study aims to understand the different types of jokes in order to appreciate the diverse range of humor and enjoy the comedic creativity present in our shared human experience. Therefore, the protection of intellectual property rights for humorous expressions is an evolving field aimed at recognizing the creative efforts of comedians and providing them with legal tools to protect their jokes. It also aims to investigate the complex issue of intellectual property rights for comedic expressions in the field of improvisational comedy and explore the challenges faced by comedians in protecting their jokes and potential conflicts that may arise regarding intellectual property. The study explored the reasons for the lack of major conflicts among comedians regarding joke ownership and how certain cases described as violations of intellectual property rights were handled. The study found that current intellectual property laws primarily protect the expression of ideas rather than the ideas themselves. This led us to delve into the study of the world of improvisational comedy, given its importance as a rich source of original and diverse jokes, as well as its susceptibility to cases of impersonation more than other forms of comedy. We also explore the complexities of protecting the author's rights in joke-related disputes, and to ensure a fair application of intellectual property rights in this field, the study provides several recommendations to address these challenges, including the need to develop clearer guidelines and standards within the improvisational comedy industry, educating comedians about intellectual property laws, promoting open dialogue, and advocating for stronger legal protection.
