جريمة التهريب في التشريع الجزائري -التكييف و الجزاء-

الملخص
بعد صدور الأمر 05/06 المتعلق بمكافحة التهريب، أصبح تكييف جرائم التهريب يتوزع بين جنايات التهريب التي خصص لها عقوبة السجن المؤبد، و جنح التهريب التي تتراوح العقوبات المخصصة لها بين سنتين و 20 سنة حبس و الغرامات الجمركية التي تتراوح بين 5 مرات قيمة البضاعة و 10 مرات قيمة البضاعة ووسيلة النقل، ومصادرة المحجوزات، مع إمكانية تطبيق واحدة أو أكثر من العقوبات التكميلية، كما قام بالنص على تشديد العقوبات الجزائية و الغرامات الجمركية في حالة العود. كما أدرج المشرع الجزائري جنحتين و هما جنحة عدم الابلاغ عن جرائم التهريب عقوبتها الحبس من ستة أشهر إلى خمس سنوات و جنحة عدم الامتثال لعملية اتلاف البضائع المغشوشة أو المنتهية الصلاحية عقوبتها من سنتين إلى خمس سنوات و هما جنحتان ملحقتان بجرائم التهريب. Abstract: After the issuance of Ordinance 05/06 related to combating smuggling, the regulation of smuggling crimes became divided between smuggling felonies for which a life sentence was assigned, and smuggling misdemeanors for which the penalties ranged between two and 20 years imprisonment and customs fines that ranged between 5 times the value of the goods and 10 times the value of the goods. times the value of the goods and the means of transport, and the confiscation of the seized items, with the possibility of applying one or more complementary penalties, and he also stipulated the intensification of the criminal penalties and customs fines in the case of recurrence. The Algerian legislator also included two misdemeanours, which are the misdemeanor of failure to report smuggling crimes with a penalty of imprisonment of six months to five years, and a misdemeanor of complying with the process of destroying adulterated or expired goods with a penalty of two to five years, and they are two misdemeanors attached to smuggling crimes.
