مدى فاعلية القانون رقم 98-04 في مجال حماية التراث الثقافي في الجزائر

الملخص
بذلت الجزائر مجهودات جبارة من أجل إرساء منظومة قانونية ناجعة لحماية التراث الثقافي الوطني ،وتركز الآليات الحمائية على ركيزتين أساسيتين: أولهما اعتماد منظومة قانونية فعالة، وثانيهما، إنشاء مؤسسات وأجهزة تتولى حماية التراث القافي والمحافظة عليه. وفي هذا السياق أصدر المشرع الجزائري عدة تشريعات وتنظيمات، لعل أهمها القانون رقم 98-04 الخاص بحماية التراث الثقافي،وان هدف من هذه الدراسة هو الوقوف على مدى فاعلية النصوص القانونية في توفير الحماية الناجعة للتراث الوطني. ومن خلال هذه الدراسة تم التوصل إلى عدة نتائج أهمها: التراث الثقافي ذاكرة الشعوب والأمم ومز من رموز الهوية لوطنية ومن تم يستلزم المحافظة عليه وحمايته للأجيال القادمة . قصور القانون 98-04 في ما يتعلق بالحماية الإدارية الرقمية للتراث الثقافي. كلمات المفتاحية: التراث الثقافي- الحماية- القانون- الهوية الوطنية. Algeria has made tremendous efforts to establish an effective legal system to protect the national cultural heritage, and the protection mechanisms focus on two main pillars: the first is the adoption of an effective legal system, and the second is the establishment of institutions and agencies that protect and preserve the rhyming heritage. In this context, the Algerian legislator issued several legislations and regulations, perhaps the most important of which is Law No. 98-04 on the protection of cultural heritage. The aim of this study is to determine the effectiveness of legal texts in providing effective protection for national heritage. Through this study, several results were reached, the most important of which are: Cultural heritage is the memory of peoples and nations and is one of the symbols of national identity. It is necessary to preserve and protect it for future generations. The shortcomings of Law 98-04 in relation to the digital administrative protection of cultural heritage.
