الملخص
تتناول هذه الورقة البحثية دور الكتابة في ظهور وتطور أول منظومة قانونية مكتوبة في حقبة زمنية موغلة في القِدم، ألا وهي "شرائع حمورابي" التي يجمع المؤرخون وفقهاء القانون في كل مكان وزمان على أنها تمثل تقدما تشريعيا وصرامة إدارية لم يشهد لها التاريخ مثيلا؛ كيف لا وقد ساهمت في إرساء العدل وتنظيم المجتمع في بلاد الرافدين؛ وهذا ما جعلها شرائع حقوقية وقانونية وكذا أطرا تنظيمية واجتماعية وثقافية في الوقت عينه. وقد سمحت لنا القراءة السوسيوثقافية لها باستخلاص جملة من النتائج نوجز أهمها فيما يأتي: * اتصاف شرائع حمورابي بالشمول والعموم وتعدد القضايا التي عالجتها، سواء كانت اجتماعية أو اقتصادية أو إدارية؛ * احتواؤها على قواعد وأحكام قانونية متنوعة لا يزال الكثير منها ساريا إلى اليوم؛ * وضوح الصبغة الأخلاقية لهذه القوانين، فالعدل والمساواة كانا أكثر ما ينشدهما حمورابي؛ * تعد شرائع حمورابي مصدر إلهام للعديد من الساسة والحقوقيين على مستوى العالم. This research paper discusses the role of writing in the emergence and development of the first written legal system in ancient times, that is, the Hammurabi Act, which brings together historians and jurists from all over the country and time, representing the progress and strictness of legislation. Never seen in the history of administration; how can it not contribute to justice and social organization in Mesopotamia? This makes it a human rights and legal framework as well as a regulatory, social and cultural framework. The sociocultural interpretation enables us to draw some conclusions, the most important of which are summarized as follows: * The comprehensiveness and universality of Hammurabi Law, as well as the diversity of issues it deals with, whether social, economic or administrative issues; * It contains various legal rules and regulations, many of which are still valid today; * To clarify the moral nature of these laws, justice and equality are the goals Hammurabi pursued most; *The Hammurabi Act is the inspiration of many politicians and jurists around the world.
