الملخص
:ملخص يعتبر تهريب المهاجرين ظاهرة من الظواهر التي أصبحت تعرف رواجا لدى غالبية بلدان المعمورة و هذا راجع للظروف المزية التي لم يعد بالإمكان معايشتها و التأقلم معها مما يدفع المهاجرين للجوء إلى طرق ملتوية و المخاطرة بحياتهم بحثا عن حياة أفضل ، و تعتبر الجزائر واحدة من تلك البلدان التي كانت و لا تزال تعاني من هذا النوع من الجرائم التي أصبحت ترتكب في إطار شبكات إجرامية محكمة التنظيم و التنسيق و هذا راجع للموقع الجغرافي الذي تتمتع به هذه الدولة مما يجعلها بلدا مستقطبا للمهاجرين غير الشرعيين و مصدرا لهم و كذلك منطقة عبور ، و هو الأمر الذي إستدعى ضرورة الوقوف على هذه الجريمة من خلال سن مجموعة من النصوص الجزائية الصارمة و السعي إلى تجسيد ذلك على المستوى الدولي من خلال مبادرتها للإنضام لمجموعة من الإتفاقيات و . المعاهدات الدولية التي تهتم بمثل هذا النوع من الجرائم ، و كذا مساهمتها في تكريس آليات التعاون الدولي بغية تحقيق الغاية المبتغاة و المثمثلة في القمع و الحماية Abstract: The smuggling of migrants is a phenomenon that has become popular in most countries of the world, and this is due to the advantageous conditions that can no longer be lived and adapted to, which pushes migrants to resort to crooked roads and risk their lives in search of a better life. Algeria is one of those countries that, It was and still suffers from this type of crime, which has become committed within the framework of well-organized and coordinated criminal networks, and this is due to its geographical location, which makes it a polarizing country for illegal immigrants and a source for them, which necessitated the need to identify this crime Through the enactment of a set of strict penal texts and seeking to embody this at the international level through its initiative to regulate a set of international conventions and treaties that are concerned with this type of crime, as well as its contribution to dedicating the mechanisms of international cooperation in order to achieve the desired goal represented in repression and protection.
