الملخص
ملخص: تعتبر إدراة الجمارك في نظر التشريع الجمركي الجهة المؤهلة قانونا لحماية الإقتصاد الوطني للبلاد بصورة رئيسية، و على هذا الأساس فقد أسندت إليها مهمة متابعة و قمع الجريمة الجمركية بجميع صورها و أصنافها كون أن هذا النوع من الجرائم له علاقة بالحقوق و الرسوم الجمركية التي تفرض على البضائع عند دخولها و خروجها من البلاد و التي تشكل موردا أوليا للخزينة العمومية للدولة ، و عليه فهي تتولى تتبع اجراءات المتابعة القضائية المتعلقة بها حرصا منها على إسترجاع الحقوق و الرسوم الجمركية المتملص منها أو المتغاضى عنها، و قد أتاح لها التشريع الجمركي من أجل بلوغ هذه الغاية صلاحية بيع البضائع محل الجريمة الجمركية في المزاد العلني أو التخلي عنها بمقابل أو بدون مقابل ، و في بعض الحالات أجاز لها إتلافها شريطة مراعاة بعض الشروط و الإجراءات. :Abstract In the eyes of the customs legislation, the Customs Administration is considered the body that is legally qualified to protect the national economy of the country mainly, and on this basis it has been assigned the task of following up and suppressing customs crime in all its forms and types, since this type of crime is related to rights and customs duties that are imposed on goods When entering and leaving the country, which constitutes a primary resource for the public treasury of the state, and accordingly, it follows the judicial follow-up procedures related to it in order to ensure the recovery of rights and customs duties that have been evaded or overlooked, and customs legislation has allowed it to achieve this goal. The authority to sell the goods subject of the customs offense in the public auction or give them away with or without .consideration, and in some cases it is permitted to destroy them, provided that some conditions and procedures are observed.
