الملخص
عتبر عقد البيع بالمزاد العلني من العقود الشائعة التي تشغل بال المجتمع لما له من أثر كبير في حياة الفرد والمجتمع، وقد صاحب تنفيذه في بعض الحالات تجاوزات دعت لضبط طريقة التعامل به لحفظ حقوق المتعاقدين، وذلك من خلال بيان الأحكام العملية لهذا العقد، وبيان شروطها وإجراءاتها ومعرفة آثارها، وقد انطلق البحث من التساؤل التالي: ما المقصود بهذا النوع من البيوع وماهي الإجراءات المحددة قانونا التي يجب اتباعها للبيع بالمزاد العلني؟. Abstract : The contract of sale auctionis a commoncontractthat people deal with, and itis of great importance because of its great impact on the life of the individual and the community, both in the field of sales and auctions real estate or movables, and the study of this type of the finestlegal and procedural issues, Some cases called for abuses to control the way in which to preserve the rights of contractors, and thisiswhatthisstudyaims by explaining the practical provisions of this contract, and itsterms and procedures and know theireffects in a comparative study of the provisions of Islamic Sharia that are rich in this field. .
