الملخص
حدد قانون التجارة الإلكترونية رقم 18-05 النظام القانوني للتعاقد عبر الوسائط الإلكترونية مشتملا على كيفية إبرامه وتنفيذه بتحديد التزامات كل من المستهلك والمورد الإلكترونيين، من خلال كتابة هذا العقد في شكل محرر إلكتروني والذي يجب أن يرتبط بتوقيع إلكتروني موصوف بناءا على شهادة تمنحها جهة التصديق الإلكترونية المرخص لها من طرف هيئة إدارية معنية بهذه المهمة، بحيث في حالة النزاع يمكن لأحد طرفي العلاقة التعاقدية الاستناد على هذه الدعامة الإلكترونية كدليل أمام القضاء. The E-Commerce Law No. 18-05 specifies the legal system for contracting via electronic media, including how to conclude and implement it by determining the obligations of both the consumer and the electronic supplier, by writing this contract in the form of an electronic editor that must be linked to an electronic signature described based on a certificate granted by the electronic certification authority Licensed by an administrative body concerned with this task, so that in the event of a dispute, one of the parties to the contractual relationship can rely on this electronic pillar as evidence before the court.
