الملخص
ملخص : من اهم القواعد التي استقر عليها القضاء قاعدة "البينة على من ادعى و اليمين على من انكر" و المقصود هنا بالبينة هي الدليل اي ان المدعي له حق لدى الغير يكون ملزما بإثبات ذلك، وهو الحال بالنسبة للمعاملات التي تتم بين الاشخاص اذ يكتسي الاثبات اهمية كبيرة في ضمان الحقوق امام الاشخاص اذ يكتسي الاثبات اهمية كبيرة في ضمان الحقوق امام القضاء و استقرار المعاملات بين الناس، ومن اهم الوسائل القانونية التي لها قوة ثبوتية في المعاملات المدنية نجد المحررات سواء كانت رسمية او عرفية حيث ضبطها المشرع الجزائري بجملة من الشروط حتى تحدث فعاليتها في ضمان حقوق المتعاملين. Abstract: One of the most important rules that the judiciary settled on is the rule of “evidence on the one who claimed and the oath on whoever denies.” What is meant here is evidence is evidence, meaning that the plaintiff has a right with others who is obligated to prove that, and this is the case with regard to interpersonal transactions, as evidence is of great importance In ensuring rights in front of people, as evidence is of great importance in ensuring rights before the judiciary and stability of transactions between people, and among the most important legal means that have evidentiary power in civil transactions, we find documents, whether official or customary, as the Algerian legislator seized them with a set of conditions for their effectiveness in Ensuring the rights of dealers.
