ملخص: يعد الاستثمار وسيلة ناجعة لجذب رؤوس الأموال و توفير العملة الصعبة، وعلى ذلك لابد من توفير مناخ مناسب و آمن للقيام بالاستثمار، وتقديم ضمانات أمنية تكفل الحماية للاستثمار وحقوق المستثمرين فمن جهة يأمن المستثمر على حقوقه ومن جهة أخرى تستفيد الدولة من ذلك الاستثمار حيث تتنوع الضمانات وتتعدد باختلاف أنواعها وبحسب طبيعة الاستثمار والطبيعة السياسية والاقتصادية المتبعة من الدولة خاصة في حال وقع نزاع بين المستثمر الأجنبي والدولة المستضيفة للاستثمار فيحتاج لحماية حقه اتجاهها أوفي حالة قامت بإجراءات من شأنها المساس بأمن واستقرار استثماره . Summary : investment is an effective way to attract capital and provide hard currency, and accordingly it is necessary to provide an appropriate and safe environment for making investment, and to provide guarantees that guarantee protection for investment and the rights of investors. On the one hand, the investor is insured of his rights and on the other hand the state benefits from that investment. Where the guarantees vary and vary in their different types and according to the nature of the investment and the political and economic nature of the state, especially in the event of a dispute between the foreign investor and the country hosting the investment, and he needs to protect his right towards it or in the event that it has taken measures that would affect the security and stability of his investment.
