حماية المستهلك في الحق في العدول عن العقد الإلكتروني في التشريع المعاصر الجزائري ـ دراسة مقارنة ـ

الملخص
لقد واكب المشرع الجزائري التطور التكنولوجي الحاصل، واعترف للمستهلك بحقه في العدول عن العقد في التعاقد عن بعد، وبالخصوص في مجال التجارة الإلكترونية التي يكون فيها عادة الطرف الضعيف في العلاقة التعاقدية أمام المورد الإلكتروني الذي يمتلك الخبرة بخبايا التجارة، مستغلا وسائل الاتصال الحديثة التي تمنع المستهلك من المعاينة الحقيقية للسلع والخدمات، مروجا لها بإعلانات أحيانا كاذبة، ما يجعل المستهلك الإلكتروني ضحية هذه المغالطات بعد إبرامه للعقد. إن إقرار المشرع للمستهلك الإلكتروني بحق العدول عن العقد، ما هو إلا مسايرة منه للتشريعات الحديثة التي اعتبرت هذا الحق من أنجع الآليات لتعزيز حماية المستهلك، لأنه يخوله التحكم في مصير العقد والتراجع عنه وفق مصلحته، وعليه أحاطه المشرع بأحكام تخص ضوابطه القانونية وآثاره، والتي يتطلب احترامها، ولقد تجلّت لنا هذه الأحكام في قانون التجارة الإلكترونية وقانون حماية المستهلك وقمع الغش، وأخرى ذات صلة، والتي كان منها ما هو مختلف ومتشابه مع أحكام التشريعات المقارنة. The Algerian legislator has kept pace with the technological development taking place, and has recognized to the consumer the right to abandon the contract in remote contracting, particularly in the area of e-commerce, where the weak party in the contractual relationship is usually in front of the electronic supplier who has experience in the trade, taking advantage of modern means of communication that prevent the consumer from genuinely inspecting goods and services, and sometimes promoting false advertising, which makes the electronic consumer the victim of these fallacies after concluding the contract. The legislator’s recognition of the right of the electronic consumer to withdraw from the contract is in keeping with modern legislation, which considered this right to be one of the most effective mechanisms for enhancing consumer protection, and therefore the legislator has informed him of provisions concerning its legal controls and effects, which require respect, which has been demonstrated to us in the Electronic Commerce Act, the Consumer Protection and Suppression of Fraud Act, and related ones, which were different and similar to the provisions of comparative legislation.
