الاعتماد المسبق آلية لرقابة قبلية لمهنة المرقي العقاري في ظل المرسوم التنفيذي رقم 19-243 المؤرخ في2019/09/28

الملخص
في ظل التوجه الاشتراكي للدولة الجزائرية، كان النشاط الترقوي كقطاع اقتصادي حكرا عليها، إلا أن بوادر عجز مؤسساتها العمومية تجلت في تلبية تطلعات المواطن وطلبه المتزايد على السكن، ما دفع بالمشرع الجزائري إلى سّن قانون 86-07، الذي فتح به المجال للقطاع الخاص للاستثمار في مهنة الترقية العقارية، هذه الأخيرة -وفي نهج اقتصاد السوق- قد تم تحريرها وإضفاء عليها الطابع التجاري لحل أزمة السكن، من خلال المرسوم التشريعي 93-03 الذي ألغى القانون المذكور أعلاه. ونظرا لسلبيات هذا التشريع قد ألغي بدوره بالقانون 11-04، الذي أعاد تنظيم المهنة بأحكام جد صارمة للتصدي لجميع التجاوزات التي كانت سائدة من قبل، حيث ألزم الحصول على الاعتماد الذي يعد أهم شهادة يثبت بها المرقي العقاري أهليته في ممارسة المهنة وكآلية لمراقبته، هذا الاعتماد الذي نظم أحكامه المرسوم التنفيذي 12-84 المعدل والمتمم بالمرسوم التنفيذي 19-243، الذي يرمي إلى تشجيع الاستثمار المحلي بمرقين عقاريين أكفاء متحصلين على شهادة عليا في الميدان، وكذلك توسيع صلاحيات الهيئات اللامركزية بمنحها لشهادة الاعتماد. In light of the socialist orientation of the Algerian state, the strengthening activity as an economic sector was its monopoly, but the signs of the inability of its public institutions were manifested in meeting the aspirations of citizens and their growing demand for housing, prompting the Algerian legislator to enact the law 86-07, which opened the way for the private sector to invest in the real estate promotion profession, the latter - and in the approach of the market economy - was liberated and commercialized to solve the housing crisis, through legislative decree 93-03, which repealed the above-mentioned law. due to the negatives of this legislation, it has also been repealed by law 1 11.04, which reorganized the profession with very strict provisions to deal with all the abuses that prevailed before, where it was necessary to obtain accreditation, which is the most important certificate by which the real estate developer proves his eligibility in the practice of the profession and as a mechanism for monitoring it, this provision was regulated by the decree executive 12.84 amended and completed by executive decree 19-243, which aims to encourage local investment with qualified real estate developers with a higher degree in the field, as well as to expand the powers of decentralized bodies by granting them a certificate of accreditation.
