الملخص
لاَ ريْبَ أنَّ الفقه الإسلامي عُنيَ بالرَّابطة الزَّوجية نصًّا ومَقصِدًا ، حُكمًا وحِكْمةً ؛ مُراعيًا فيها اتِّسامَها بالرِّضائية ، ومشدِّدًا على المُشترَكاتِ بينَ الزَّوجين ؛ بُغيةَ اِبْتناءِ أُسرَةٍ تلتئمُ في ظلال المودَّة والرَّحمة ، وتتناغَمُ في إطار الإحصان والعِفَّة ؛ بيْدَ أنَّ تلك الرضائية قدْ يشوبُ صفوَها أساليبُ الإكراه المستعملَة مِن لدُنِ الزَّوج لقضاءِ وطَره الجنسي ، ممَّا يَطرحُ التَّساؤلَ عن حقِّ الزَّوجة في التَّأبِّي والامتناع عنْ الاِنخراط في هذه المُعاشرة الجنسية . وعطفًا على ذلكَ ترومُ هذه الدِّراسة التَّطوافَ بمَبحث "الإكراه الجنسي بين الزَّوجين" مِنْ زاوية الفقه الإسلامي و بدرجةٍ أقلّ قانون الأُسرة الجزائري . Abstract: There is no doubt that Islamic jurisprudence is concerned with the conjugal bond, both text and intent, as well as wisdom and wisdom. Taking into account its complacency and emphasizing the commonality between spouses; In order to build a family that heals in the shade of affection and mercy, and harmonizes within the framework of immunity and chastity; However, that consent may be tainted by the methods of coercion used by the husband to spend his sexual relations, which raises the question of the wife's right to refuse and refrain from engaging in this sexual intercourse. In addition, this study aims to circulate the topic of "sexual coercion between spouses" from the angle of Islamic jurisprudence and to a lesser extent the Algerian family law.
