الملخص
تستبطنُ هذه الدِّراسة مقاربةً قانونيةً ترومُ طرْقَ موضوع "الطُّفولة الجَانحَة" من خلال المدخَل الحِمائي ؛ مُحاوِلَةً التَّعرُّف إنْ كان ثمَّةَ علاقةٌ بين طبيعة التَّدابير المرصودة في قانون 15-12 المتعلق بحماية الطفل ، وبين الآليات الوقائية مِن مخاطر الاِنضمام إلى عِصابات الأحياء ، المرصودة في أمر 20-03 المتعلق بالوقاية من عصابات الأحياء ومكافحتها . ومِن ثمَّ فالقصدُ الحديثُ عن المقاربة الوقائية في التَّشريعين السَّابقين ؛ لِحاجة الطفولة الجانحة إليها ؛ بُغيةَ لفْت النَّظر إلى هشاشة هذه الفئة في المُجتمع ، والتي قدْ تكون فريسةً سهلة في استقطابها وتَلقُّفِها من قِبَل عصَابات الأحياء . Abstract: This study explores a legal approach that seeks to tackle the topic of "delinquent childhood" through the protective approach; Trying to find out whether there is a relationship between the nature of the measures stipulated in Law 12-15 relating to child protection, and the preventive mechanisms against the dangers of joining neighborhood gangs, set forth in Ordinance 20-03 on preventing and combating neighborhood gangs. Hence, the intention is to talk about the preventive approach in the two previous legislations; The need for delinquent childhood; In order to draw attention to the vulnerability of this group in society, which may be an easy prey for its recruitment and capture by neighborhood gangs.
