الملخص
ملخص: أن كل المنظومة القانونية لدولة الجزائرية تعزز المركز القانوني لرئيس الجمهورية مما يجعل كل الهيئات الدستورية تتأثر بهذا المركز بما يخدم السلطة التنفيذية أكثر من باقي السلطات سواء بصفة مباشرة أو غير مباشرة. إلا أن الهيمنة التي تفرضها السلطة التنفيذية على باقي السلطات في الحقيقة ليس مردها إلى تعنت هذه السلطة وتزايد قوتها بل إلى ضعف العلمي و المعرفي لتركيبة البشرية لنواب البرلمان خصوصا من الناحية القانونية، كما ترد أيضا لمشكلة عدم استقلالية القضاء المبدأ الذي طالما ينادي به كل المهتمين بالمجال القانوني والقضائي، ومع هذا يبقى المجلس الدستوري بالتعداد السابق للتشكيلة أو الحالي أكثر مؤسسة دستورية تمثل التوازن والتشارك بين السلطات وهو من بين الأجهزة القليلة في الدولة التي بها تمثيل لكل السلطات . Abstract: The entire current legal system of the Algerian State strengthens the legal power of the President of the Republic, which places all constitutional bodies under the influence of this power on the one hand, which serves the executive power at the expense of other authorities directly or directly. or indirectly. However, the domination imposed by the executive power to the detriment of the rest of the authorities is not really due to the intransigence of this authority and its growing force, but rather to the scientific and episodic inadequacy of the current human component of parliamentarians. . , in particular the legal competence on one side, and on the other, the lack of judicial autonomy, this principle so defended by the persons concerned in the legal and judicial field, and yet the Constitutional Council remains with its previous human component or current, the most constitutional institution reflecting the balance and the partnership between the authorities, as well as among the rare organs of the country which have the representativeness of all the authorities.
