الملخص

ملخص: حالة الحرب هي من أخطر حالات الظروف الاستثنائية التي نظمها الدستور الجزائري ، و وضع ثلاث استثناءات لمجابهة الأوضاع التي تصاحبها و النتائج التي تنجر عنها، حيث يوقف العمل بالدستور مدة حالة الحرب ، و يتولى رئيس الجمهورية جميع السلطات ، و في حالة انتهاء المدة الرئاسية تمدد وجوبا إلى غاية نهاية الحرب ، و هو ما يفرض على المؤسس الدستوري تحديد شروط إعلانها و تسييرها لضمان سلامة شعبها ، و استمرارية الدولة و استقلالها. Abstract: The state of war is one of the most dangerous cases of exceptional circumstances regulated by the Algerian constitution, and three exceptions are put in place to confront the conditions that accompany it and the results that result from it, as the constitution of the state of war is suspended, and the president of the republic assumes all powers, and in the event that the presidential term expires Juba until the end of the war , this requires the constitutional founder to define the conditions for its proclamation and conduct to ensure the safety of its people, and the continuity and independence of the state
