الملخص
عند دراسة و تحليل عمل المجلس الدستوري نصادف أحيانا آراء للمجلس تتضمن تصويبات وتصحيحات للمشرع، وأحيانا يتعدى الأمر ذلك إلى تقديم صياغات جديدة وأحيانا تفسيرات وتحليلات سواء لنص الدستوري محور(مرجع الرقابة)، أو للنص المراقب (موضوع الرقابة)، وإن دل هذا على شيء فهو يدل على إسهام هذه الهيئة الرقابية وبمناسبة عملها الدستوري في العمل التشريعي، وفي كل الأحوال لا يمكن تصور أن المجلس الدستوري بهذا أصبح مشرعا فعليا يوازي عمله عمل السلطة التشريعية، غير أنه يمارس التشريع بصفة استثنائية لإنقاذ النص القانوني المراقب من التصريح بعدم الدستورية. When studying and analysing the work of the Constitutional Council, we sometimes encounter the opinions of the Council, that include corrections to the legislator, and sometimes it goes beyond that to introduce new formulations and sometimes interpretations and analyses, whether for the constitutional text (control reference), or for the observer text (subject of censorship), although this indicates the contribution of this oversight body on the occasion of its constitutional work in legislative work, and in any case it is inconceivable that the Constitutional Council has become an effective legislator equivalent to the work of the legislature, however it exercises exceptional legislation to save the observed legal text from declaring unconstitutional.
