فيروس كورونا Covid-19 كظرف طارئ في مجال الصفقات العمومية في القانون الجزائري

الملخص
الملخص: تعد الامراض والاوبئة مجالات ذات تأثير كبير على القطاعات الحيوية لأي دولة بما قد لا يتلاءم والسياسة المتخذة داخل الحدود الإقليمية للدول، خاصة القطاع الاقتصادي وما تعلق منها بسير المرافق العامة، في اطار تنفيذ المشاريع وإنجاز الصفقات العمومية، ولعل ظهور فيروس كورونا كان السبب المباشر في تعطيل انجاز المشاريع ومنه التأثير في سير المرافق العامة وعدم تلبية حاجات الأفراد من جهة، وكذا الاضرار بمصالح الأطراف المتعاقد خاصة في مجال الصفقات العمومية، على هذا الأساس تم إقرار عدة نظريات في هذا الشأن مثل نظرية الظروف الطارئة من أجل إعادة التوازن المالي للصفقة. Abstract: Diseases and epidemics are areas that have a great impact on the vital sectors of any country, which may not suit the policy taken within the territorial borders of countries, especially the economic sector and what is related to the functioning of public facilities, within the framework of the implementation of projects and the completion of public deals, and perhaps the emergence of the Corona virus was the direct cause of disruption Completing projects, including affecting the functioning of public utilities and not meeting the needs of individuals on the one hand, as well as harming the interests of the contracting parties, especially in the field of public deals, on this basis, several theories were approved in this regard, such as the theory of emergency conditions in order to restore the financial balance of the public deal.
