آليات حماية الصحة في الوسط المدرسي في الظروف العادية و في ظل جائحة كورونا ( كوفيد 19 ) كظرف استثنائي

الملخص
ملخص: نظرا لأهمية الصحة في الوسط المدرسي، أدركت وزارة التربية الوطنية مسؤوليتها، فأولت لهذا الموضوع أهمية قصوى، وبمشاركة الوزارات الأخرى أقامت هياكل وفرق صحية لمتابعة صحة التلاميذ، و لقد كان لجائحة كورونا ( كوفيد 19 ) تأثير كبير على المدارس، الأمر الذي أدى إلى اتخاذ تدابير وقائية خاصة تتواكب مع قطاع التربية للحد من انتشار هذا الفيروس بين التلاميذ، وتهدف هذه الدراسة إلى إبراز الإجراءات القانونية التي أقرتها وزارة التربية الوطنية لرفع المستوى الصحي للتلاميذ في المدارس في الظروف العادية، و لمواجهة جائحة كورونا ( كوفيد 19 ) كظرف استثنائي، ولعل أهم النتائج المستخلصة كانت أنه رغم الجهود المبذولة من طرف وزارة التربية من أجل تجسيد الحق في الحماية الصحية في الوسط المدرسي، من خلال سن العديد من النصوص التنظيمية، إلا أن هذه النصوص لم تطبق وتجسد بالشكل المطلوب على أرض الواقع، و إن الكثير منها يحتاج إلى المراجعة لمواكبة المستجدات. Abstract Given the importance of health in the school environment, the Ministry of National Education realized its responsibility, and gave this issue the utmost importance, and with the participation of other ministries, it established health structures and teams to follow up on the health of students, and the Corona pandemic (Covid 19) had a significant impact on schools, which led to the adoption of preventive measures. Especially in line with the education sector to limit the spread of this virus among students, and this study aims to highlight the legal procedures approved by the Ministry of National Education to raise the health level of students in schools under normal conditions, and to confront the Corona pandemic (Covid 19) as an exceptional circumstance, and perhaps the most important results extracted It was that despite the efforts made by the Ministry of Education to embody the right to health protection in the school community through the enactment of many regulatory texts, these texts were not implemented and embodied as required on the ground, and many of them need review to keep pace with developments
