جريمة سرقة التيار الكهربائي في التشريع الجزائري والتشريع المقارن

الملخص
لقد عالجت هذه الدراسة موضوع جريمة سرقة التيار الكهربائي باعتبارها من الأموال العامة وذلك لما للتيار الكهربائي من أهمية كبيرة والتي يجب المحافظة عليه وعدم العبث أو التعدي عليه، وبالرغم من أهميته فإن المشرع الجزائري لم ينظمها في نصوص قانونية، غير أن بعض من التشريعات المقارنة كرستها في نصوص قانونية خاصة من ناحية تحديد العقوبة المقررة لها، وقد تم طرح إشكالية عامة تبرز من خلال تحديد أهم الأحكام القانونية في جريمة سرقة التيار الكهربائي، من خلال تقسيمها إلى محورين من خلال التعريف بهذه الجريمة وكذا تحديد أركانها والجزاء المقرر لها، واستخلصنا بأنه بالرغم من كثرة شيوع هذه الجريمة إلا أننا لم نجد لها القدر الكافي من النصوص القانونية التي تنظمها سواء من ناحية المفاهيم الخاصة بها أو من ناحية تحديد الجزاء على مرتكب هذه الجريمة. This study has been conducted on the issue of stealing electricity, which is considered as public funds, due to the great significance of the electric current that is ought to be preserved and not tampered with or violated. Regardless its importance, the Algerian legislature did not regulate it within legal provisions; however, some other comparative legislations enshrined it in special legal texts, especially in terms of defining the penalty prescribed for it. A general issue has been raised through defining the most important legal provisions in the crime of stealing electricity by dividing it into two axes based on defining such crime, as well as defining its elements and the penalty determined for it. It was concluded that in spite of the high prevalence of such crime, there exists insufficient number of legal texts for its regulation, whether in terms of its concepts or in terms of determining the penalty for the perpetrator of this crime
