الملخص
ملخص: جرائم سرقة المواد النووية في التشريع الوطني الجزائري تعد جريمة سرقة المواد النووية من الجرائم النووية التي أخذت أهمية كبيرة عند المنظمات الدولية والتي حثت دول العالم على تجريمها في قوانينها الداخلية خصوصا بعد الدمار التي خلفته قبلتی هیروشیما و ناكاراكي في نهاية الحرب العالمية الثانية سنة 1945 وما شهده العالم من خطورة متعلقة بطبيعة هذه المواد، ثم الهجمات الإرهابية التي شهدها العالم أيضا في 2001/09/11 في الولايات المتحدة الأمريكية والتي زادت من مخاوف وقرع هذه المواد الخطيرة بأيدي الإرهابيين، فبدأت تدخل هذه الجريمة تدريجيا ضمن القوانين الجنائية الداخلية للدول لما رأت هذه الدول مدى خطورتها على أمن مجتمعاتها. أما عند المشرع الوطني الجزائري فكانت هذه الجريمة تخضع للأحكام العقابية العامة باعتبار هذه المواد ممتلكات منقولة ذات قيمة مادية قد تتعرض للسرقة وتغطيها بتلك المواد 350 وما يليها من قانون العقوبات المتعلقة بهذا السلوك إلى حين صدور قانون 19-05 المتعلق بالنشاطات النووية في الجزائر سنة 2019. Abstract: The crimes of theft of nuclear materials are among the nuclear crimes that have taken on great importance among international organizations, which urged the countries of the world to criminalize them in their internal laws, especially after the devastation caused by the Hiroshima and Nagasaki bombs at the end of World War II in 1945, and the dangers the world witnessed related to the nature of these materials. Then the terrorist attacks that the world also witnessed on September 11, 2001 in the United States of America, which increased the fears of these dangerous materials falling into the hands of terrorists, so this crime began gradually to be included in the internal criminal laws of countries when these countries saw how dangerous it is to the security of their societies. As for the Algerian national legislator, this crime was subject to general punitive provisions, considering that these materials are movable property of material value that may be subject to theft and are covered by articles 350 and the following of the Penal Code related to this behavior until the issuance of Law 19-05 related to nuclear activities in Algeria in 2019.
