الملخص
يتناول هذا البحث أحكام زواج الصغار في قانون الأحوال الشخصية العراقي مقارنة بالشريعة الإسلامية والعرف الاجتماعي المتداول في المجتمع. والغرض منه هو بيان أوجه التعارض وعدم الانسجام بين القانون وبينهما بهدف تحديدها واقتراح ما يزيلها، وكذلك التعرّف على مدى استيعاب القانون لأحكام زواج الصغار. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي والمقارن. واختتم البحث بنتائج وهي: عدم وجود تعارض حقيقي بين القانون والشريعة والتعارض الموجود هو تعارض ظاهري، كما جاء موقف القانون منسجماً مع العرف الاجتماعي إلاّ في مسألتين: الأولى، تتعلق بدور الولي في ولاية النكاح، والثانية باشتراط القابلية البدنية للصغير المقدم على الزواج. إضافة إلى ذلك، لم يغطِّ القانون كافة أحكام زواج الصغار واعتراه بعض الثغرات التشريعية. This research deals with the provisions of the marriage of minors in Iraqi personal status law compared to Islamic law and social Custom rolling in the society. Its purpose is to clarify the inconsistencies and lack of harmony between the law and between them, with the aim of identifying them and suggesting what to remove them, as well as identifying the extent to which the law include the provisions of minors’ marriage. In order to achieve this, the researcher used the inductive analytical and comparative method. The research was concluded with results, which are: there is no real conflict between the law and Islamic law, and the existing conflict is an apparent conflict, as the position of the law came in harmony with social custom, except in two matters: the first, concerning the role of the guardian in the guardianship of marriage. The second, stipulating the physical ability of the minor who is about to marry. In addition, the law did not cover all the provisions of minors’ marriage and had some legislative gaps.
