أحكام جريمة خطف الحدث في قانون العقوبات العراقي The Provisions Of The Crime Of Juvenile Kidnapping In The Iraqi Penal Code

الملخص
يتناول هذا البحث أحكام جريمة خطف الحدث في قانون العقوبات العراقي. الغرض منه هو إزالة الغموض التي تعتريها هذه الأحكام، وبيان التعديلات التي أجريت عليها، ومعرفة فيما إذا كانت النصوص التي تتناول هذه الجريمة تشوبها ثغرات تشريعية من عدمها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي، المقارن، والنقدي. وأهم النتائج التي توصلت إليها البحث، هي: إجراء ثلاثة تعديلات على أحكام جريمة خطف الحدث من قبل المشرع العراقي في السنوات (2002، 2003، 2004) على التوالي، إضافة إلى ذلك فإن النصوص التي تتناول هذه الجريمة تعاني فجوات تشريعية، منها: عدم شمول الصغير الذي لم يبلغ سن الحدث بالحماية الجنائية من الخطف، وعدم شمول الحدث بالحماية المشدّدة في حالة تعرضه لفعل اللواط من قبل الجاني. واختتم البحث بتوصية المشرع بتعديل المادة (422) واقترحنا عليه نصاً بديلاً لتجنب المآخذ الموجهة إليها قدر الإمكان. This research deals with the provisions of the crime of juvenile kidnapping in the Iraqi Penal Code. Its purpose is to remove the ambiguity in these provisions, show the amendments that were made to them, and knowing whether the texts dealing with this crime are marred by legislative loopholes or not. In order to achieve this, the researcher used the analytical inductive, comparative, and critical method. The most important results of the research are: Three amendments were made to the provisions of the crime of juvenile kidnapping by the Iraqi legislator in (2002, 2003, 2004) respectively. In addition, the texts dealing with this crime suffer from legislative loopholes, including: A child who has not yet reached the age of juvenile is not covered by criminal protection against kidnapping and the juvenile is not included in strict protection in the event that he/she is subjected to sodomy by the perpetrator. The research concluded by recommending the legislature to amend article (422), and we suggested an alternative text to avoid the criticisms directed to it as much as possible.
