الملخص
ملخص: تهدف هذه الدراسة إلى إبراز دور التأويل في فهم النصوص الشرعية، وذلك من خلال جملة من القواعد والآليات التي استعان بها جمهور الأصوليين في سبيل استنطاق النصوص. فانطلقت الدراسة من الإيمان بأنَّه لا بد لفهم نصٍ من النُّصوص الشرعية من استحضار جميع القرائن الملابسة للكلام كالسياق الذي يرشد إلى تبيين المجمل وتعيين المحتمل والقطع بعدم احتمال غير المراد وتخصيص العام وتقييد المطلق وتنوع الدلالة وهذا من أعظم القرائن الدالة على مراد المتكلم فمن أهمله غلط في نظره وغالط في مناظرته. Abstract: This study aims to highlight the role of interpretation in the understanding of the legal texts, through a set of rules and mechanisms used by the majority of fundamentalists to explore the texts. The study began from the belief that it is necessary to understand the text of the texts of the legitimacy of the evocation of all the clues to the words of the context, which leads to the identification of the total and the appointment of the potential and cut the possibility of non-intended and the allocation of the year and the restriction of absolute and diversity of significance and this is one of the greatest clues to the intent of the speaker, And Galt in his debate.
