نظام نفقة المحضون بين الإشكالات العملية و الحلول القانونية في التشريع الجزائري Child Maintenance System Between Practical Challenges And Legal Solutions In Algerian Legislation

الملخص

ملخص: نفصل من خلال هذا المقال في موضوع النفقة التي أقرها المشرع الجزائري للطفل المحضون بعد فراق والديه، بإعتبارها من أهم الأنظمة التي جاءت لحماية الطفل في الجانب المادي، ونتبين إشكالات كشفها الجانب العملي، تجسدت في صعوبات التقدير والتحصيل، ونتفحص أسباب ذلك، الذي إتضح أنه إما بسبب قصور النصوص القانونية، أوبسبب ممارسات فردية للتملص من أداء النفقة، محاولين إيجاد علاجات فعالة بالإعتماد على الإجتهادات القضائية وتجارب تشريعية رائدة. Abstract: َ In this article, we elaborate the subject of maintenance, approved by the Algerian legislator for the child entitled after the separation of his parents ; as one of the most important regulations that came out to protect the child in the physical side, and we identify some of the problems revealed during our research , and which are mainly , the difficulties of estimation and evaluation and trying to examine the reasons behind that .Those challenges turned out to be either due to the legal texts deficiency, or because of individual malpractices to evade maintenance, and hence, trying to find effective remedies to those problems ,relying on judicial practices and pioneering legislative experiences.
