" تمكين المرأة في التشريع الجزائري " Empowering Women In Algerian Legislation

الملخص

ملخص الدراسة: تعتبر مشاركة المرأة في تنمية المجتمع بمثابة محرك له، فلا يمكنه المضي قدما في حركة التنمية المستدامة دون صلاحيتها لذلك، وليتحقق هذا الامر لابد من تمكينها وترقية ودعم دورها في الاسرة والمجتمع، بالقضاء على جميع اشكال التمييز الممارس والموجه ضدها لاسيما القائم منه على الجنس، ما من شأنه الحد من فاعليتها وقدراتها، الامر الذي يستدعي دراسة النصوص القانونية التي أقرها المشرع الجزائري لتمكين المرأة وحمايتها ، ولذلك أجرينا في هذه الدراسة مسح لمختلف التشريعات الوطنية والتي تتضمن المساواة بين الرجل والمرأة أو بالأحرى تمكينها، لنصل الى أن باطن مفهوم التمكين باعتباره مصطلح غربي يراد به في الحقيقة غير ظاهره. Study Summary: The participation of women in the development of society is an angine, that cannot move forward in the sustainable development movement without its validity ,to achieve this ,it must be empowered ,promoted and supported by its role in the family and society and elimination of all forms of discrimination against women , particularly those based on sex ,which would limit their effectiveness and capacity, This calls for studying the legal texts approved by the Algerian legislature for the empowerment and protection of women, and therefore we conducted in this study a survey of various national legislations that include equality between men and women or rather their empowerment, in order to arrive at the concept of empowerment as a Western term intended in reality is not apparent.
