الملخص

فرض انتشار فيروس كورونا نمطا جديدا من الأزمات الاستثنائية استدعى تعامل الحكومات والهيئات الدولية معه بشكل سريع باتخاذها جملة من الإجراءات والتدابير الوقائية، مست العديد من الحقوق الأساسية والحريات العامة للأفراد بما فيها تقييد حريتهم في التنقل وجبرهم على احترام شروط الحجر الصحي العام تفاديا لانتشار الفيروس والتقليل من مخاطره. إلا أن هذه الإجراءات طرحت الجدل القانوني حول دستوريتها ومدى تنفيذ الدول لالتزاماتها الدولية بخصوص ضمان حرية التنقل والإقامة للأشخاص في ظل التقييد والمنع الذي فرض عليهم. وهذا ما حاولنا الإجابة عنه في الورقة البحثية من خلال دراسة حالتي الجزائر والمغرب في معالجتهما للأزمة الصحية الطارئة واحترامها للقوانين المنظمة للحريات الفردية ا Abstract: The spread of the Corona virus imposed a new pattern of exceptional crises that required governments and international organisations to deal with it quickly by taking a set of preventive measures and measures. Many basic rights and public freedoms affected individuals, including restricting their freedom of movement and forcing them to respect general quarantine conditions in order to avoid the spread of the virus and reduce the risk. However, these measures raised legal controversy over their constitutionality and the extent to which states implement their international obligations regarding ensuring freedom of movement and residence for people under the restrictions and prohibitions imposed on them. This is what we tried to answer in the research paper by studying the cases of Algeria and Morocco in their treatment of the emergency health crisis and their respect for the laws governing individual freedoms.
