مبدأ تسليم المجرمين كإجراء لتكريس العدالة الجنائية الدولية

الملخص
يعد مبدأ تسليم المجرمين من بين الإجراءات القانونية المتخذة من طرف الدول في مجال التعاون الجنائي الدولي في سبيل محاربة الجريمة الدولية والقضاء عليها وبالتالي ضمان تحقيق الأمن والعدالة الدولية وعدم إفلات الجناة من المسؤولية الجنائية، والحقيقة أن إجراء التسليم ينظم عادة عن طريق عقد اتفاقيات ثنائية أو متعددة الأطراف، وفيها تتفق الدول المتعاقدة على الشروط والقواعد التي يتم فيها التسليم، وهي بذلك تحافظ على هيبتها وتؤكد فرض سيادتها على إقليمها وتوقيع العقاب على مرتكب الجريمة على أراضيها وعدم تمكنه من التخلص من العقاب بهروبه إلى دولة أخرى. :Abstract The principle of extradition is among the legal measures taken by states in the field of international criminal cooperation in order to fight and eliminate international crime and thus ensure the achievement of international security and justice and the failure of perpetrators to escape criminal responsibility, and the fact that extradition is usually regulated by concluding bilateral or multiple agreements The parties, in which the contracting states agree on the terms and rules in which extradition takes place, thereby preserving their prestige and asserting the imposition of their sovereignty over their territory and the punishment of the perpetrator of the crime on their territories and the inability to get rid of the punishment by fleeing to another contry.
