ملخص: تعرف العلاقات الجنسية نظرة متضاربة بين الدين الذي يراها جريمة تستحق القتل والحريات الفردية والجماعية الحديثة التي تراها حقا مشروعا للفرد والجماعة المتحضرة وكطرف ثالث يحاول القانون الوضعي التوفيق بين النظرتين المتعارضتين، لذلك يجب الوقوف على أصل النظرتين حتى يتبين جوهر هذا العمل المختلف فيه ظاهرا والمتفق حوله باطنا. Abstract The sexual relation are becoming more and more subject of discution between the religious views which consider it as a crime require a sendence punishement and modern individual freedom concepts which cosider it as a legal natural behaviour for the civilized community and individuals in the other hand the human law as part trying to made a balance between the two thus it is very important to study both theories inorder to understand the core of this issue.
