الملخص
ملخص: تهدف هذه الدراسة إلى تحديد أهم الصعوبات والعراقيل التي تعترض قيام ميثاق عالمي موحد لحماية الاستثمارات الأجنبية، أو ما يسمى بإشكالية عولمة قانون الاستثمار، إذ يعد السعي نحو وضع تنظيمات متعددة الأطراف ذات مدى عالمي في مجال الاستثمار من الظواهر القانونية التي طبعت الساحة الدولية في مجال القانون الاقتصادي الدولي، إذ حاولت الدول المصدرة والمستوردة لرؤوس الأموال سواء على المستوى الوطني والإقليمي والعالمي إلى البحث عن ميثاق عالمي لحماية الاستثمارات الأجنبية يرضي الدول المصدرة والمستوردة للرسمايل على حد سواء، غير أنه من الملاحظ قد ظهرت صعوبة عملية يتم من خلالها تدويل قانون دولي يساهم في حل المشاكل المتعلقة بحماية الاستثمارات الأجنبية المباشرة. Abstract: This study aims to identify the most important difficulties and obstacles that hinder the establishment of a unified global pact to protect foreign investment, or the so-called globalization of investment law, as seeking to develop multilateral organizations with a global scope in the field of investment is one of the legal phenomena that have characterized the international scene in the field of economic law The international community, as both the exporting and importing countries of capital tried at the national, regional and global levels to search for a global pact to protect foreign investments that satisfies both the exporting and importing countries of capital, but it is noticeable that a practical difficulty has arisen During which the internationalization of international law contribute to solving the immediate problems related to the protection of foreign investments.
