الملخص

بعد أن زادت الأخطار والتهديدات البيئية، وفاقت الآثار السلبية لتلك الأخطار والتهديدات حدود المألوف، وكثر وقوع الكوارث البيئية بفعل العولمة وما صاحبها من تقدم صناعي وتكنولوجي هذا من جهة، ومن جهة أخرى استغلال الإنسان غير الرشيد وغير العقلاني للموارد الطبيعية أدى إلى المساس بأمن البيئة وعناصرها، والتسبب في حدوث الأضرار البيئية، الأمر الذي دفع المجتمع الدولي لمواجهة هذا الوضع الرهيب بوضعه لقواعد المسؤولية عن التلوث البيئي، وذلك من أجل تأمين الحماية القانونية للبيئة وتعزيز تطبيق القانون، وحتى يكون الحديث متاحا عن قواعد المسؤولية المدنية عن الأضرار البيئية التي يطالب بها المتضرر أمام القضاء يجب أن يراعي جملة من الشروط للمطالبة بالحماية القانونية منها الإجرائية ومنها الموضوعية. After the environmental dangers and threats increased, and the negative effects of those dangers and threats exceeded the usual limits, and the occurrence of environmental disasters increased due to globalization and the accompanying industrial and technological progress on the one hand, and on the other hand, the irrational and irrational human exploitation of natural resources led to compromising the security of the environment and its elements, And causing environmental damage, which prompted the international community to confront this terrible situation by setting the rules of responsibility for environmental pollution, in order to secure legal protection for the environment and strengthen the application of the law, and so that talk is available about the rules of civil liability for environmental damage claimed by the victim before the courts He must take into account a number of conditions to claim legal protection, including procedural and substantive ones.
