الجرائم المستحدثة، ضبط المفهوم وتحديد الأنماط

الملخص
نسعى في هذه المقالة إلى دراسة الجرائم المستحدثة دراسة شاملة موضوعا وشكلا، من خلال تبيان مفهوم هذه الجرائم، واستعراض أنواعها، وما يميزها عن باقي الجرائم الأخرى، بالإضافة إلى أسباب ظهور وانتشار الجرائم المستحدثة، فموضوع الجرائم المستحدثة أصبح يلقى اهتماما في الآونة الأخيرة، خاصة وأن هذه الجرائم عبرت حدود الوطن، إن لم نقل أنها تكسح بلدانا بأكملها لاسيما وأن هذه الجرائم تقوض سبل التنمية والأمن في البلدان التي تنتشر فيها، وتثير مسألة الجرائم المستحدثة مسألة مهمة تتمثل في عدم توافق الفقهاء والباحثين في تعريفها، وذلك يرجع إلى الاختلاف في المعايير التي يستند إليها هؤلاء الفقهاء في اعتبار الجريمة مستحدثة أم لا. ونخلص في آخر دراستنا إلى أن الجرائم المستحدثة هي جرائم عبر وطنية لها من الخطورة والتهديد بما يكفي لتكون في مطلع اهتمامات المجتمع المحلي والدولي ككل، وهي تلك الجرائم المستجدة وغير معروفة قبلا لدى المجتمعات، إضافة إلى الجرائم التقليدية الخطيرة، وأصبحت أكبر خطورة وجسامة من ذي قبل نتيجة اعتمادها المباشر على كل ما استجد تكنولوجيا وعلميا وتوظيفها لكل التقنيات الحديثة. In this article, we seek to study the new crimes comprehensively in substance and form, by clarifying the concept of these crimes, reviewing their types, and what distinguishes them from the rest of the other crimes, in addition to the reasons for the emergence and spread of new crimes, the subject of new crimes has recently received attention, especially since these crimes crossed the borders of the homeland, if not to say that they sweep entire countries, especially since these crimes undermine the means of development and security in the countries in which they are spread, and the issue of new crimes raises the issue of The task is that jurists and researchers do not agree in its definition, due to the difference in the criteria on which these jurists rely in considering the crime new or not. At the end of our study, we conclude that the new crimes are transnational crimes of sufficient gravity and threat to be at the forefront of the concerns of the local and international community as a whole, and they are those emerging crimes that are not previously known to societies, in addition to serious traditional crimes, and have become more serious and serious than before as a result of their direct dependence on all technological and scientific developments and their employment of all modern technologies.
