حماية مصالح المستهلك والمورد الالكترونيين في التنظيم التشريعي للحق في العدول

الملخص
الملخص: أقرّ المشرّع الجزائري الحق في العدول عن العقد للمستهلك الالكتروني، ونظّمه بما يحقّق مصلحته باعتباره الطرف الضعيف فنيّا واقتصاديا في العلاقة مقارنة مع المورد الالكتروني؛ إذ منحه هذا الحق، دونما حاجة إلى مبرارات، أو إلزام بتكاليف غير تلك المرتبطة برد المنتوج، وهذا خروجا عن مبدأ القوة الملزمة للعقد، وجعله من النظّام العام، مراعيا لاعتبارات العدالة التعاقدية، ولكن من جهة أخرى راعى مصالح المورد الالكتروني، من خلال وضع شروط يتعيّن الالتزام بها من طرف المستهلك الالكتروني، كما نص على إمكانية استثناء بعض العقود من نطاق ممارسته، حفاظا على استقرار المعاملات، ولكن هذا التنظيم التشريعي لم يكن كافيا، محقّقا لغايته، بسبب عدم إصدار النص التنظيمي، الذي ينبغي التفصيل ضمنه في العديد من المسائل المهمّة، على غرار العديد من المشرعين. Abstract: The Algerian legislator recognized the right of withdrawal from the contract to the electronic consumer and organized it to serve his interest, being the technically and economically weak party in the relationship with the electronic supplier. Grant him this right, without the need for justifications, and without commitment of additional cost, and this undermines the principle of the binding force of the contract, and it is of public order, taking into account considerations of contractual justice, but it is also protected the interests of the electronic supplier, by fixing the conditions of exercise of this right, as well as the possibility of excluding certain contracts, in order to preserve the stability of the transactions, but this legislative regulation was not enough to achieve its goal. This is due to the lack of publication of the regulatory text which should be detailed in many important areas, like other legislators.
